Please read these terms of service carefully before using Toast.
1. Introduction
Welcome to Toast. These Terms of Service ("Terms") govern your access to and use of the Toast website, apps, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services. If you are accessing and using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.
2. Account Registration

3. Subscription and Payments
Toast offers both free and paid subscription plans. By selecting a paid subscription, you agree to pay the subscription fees indicated for your selected plan. Subscription fees are billed in advance on a monthly or annual basis, depending on the payment plan you select.
Payment must be made using one of our accepted payment methods. You authorize us to charge your selected payment method for all fees incurred by your account. If your payment cannot be completed, we may suspend or terminate your access to the paid features of the Services.
Subscription fees are non-refundable except as expressly provided in our Refund Policy or as required by applicable law. You may cancel your subscription at any time, but no refunds will be issued for the current billing period unless otherwise specified in our Refund Policy.
We reserve the right to change our subscription fees at any time. If we change our fees, we will provide notice of the change on the website or by email, at our discretion. Your continued use of the Services after such notification constitutes your acceptance of the new fees.
4. User Content
Our Services may allow you to create, upload, store, share, or otherwise make available certain content, including but not limited to text, data, and configurations ("User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Services.
By making any User Content available through the Services, you grant to Toast a non-exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Services.
You represent and warrant that: (i) you own or have the necessary rights to use and to authorize Toast to use your User Content as described herein; and (ii) your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person.
5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Services for any illegal purpose or in violation of any local, state, national, or international law
- Violating or infringing other people's intellectual property, privacy, publicity, or other legal rights
- Transmitting any material that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity
- Interfering with or disrupting the Services or servers or networks connected to the Services
- Attempting to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
- Using any automated means, including bots, scrapers, or similar technologies, to access or use the Services
- Attempting to reverse engineer, decompile, or disassemble any portion of the Services
6. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of Toast and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Toast.
7. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Toast does not warrant that: (a) the Services will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Services are free of viruses or other harmful components; or (d) the results of using the Services will meet your requirements.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOAST, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.
UNDER NO CIRCUMSTANCES WILL TOAST BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOAST ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY: (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICES; (III) UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
